CDA Gaming Wins Court Order to Restore Brazil Betting Operations

The decision covers Casa de Apostas, Betsul and Jogo Online. All three had been affected by Provisional Measure 1,394/2026, which banned fixed-odds betting in Brazil and terminated existing licences after 30 days.
CDA Asked to Keep Refund Systems Running
The operator had already lost its first injunction request in São Paulo. Its appeal challenged the early cancellation of a licence granted under Ordinance SPA/MF 255/2025.
In the November 3 ruling, Judge Adriana Pileggi de Soveral described the government’s refusal to refund licence fees as "a genuine confiscation."
CDA had prepared a fallback request. If betting could not resume, it wanted to retain its banking interfaces, back-office systems and customer support to refund players and report to regulators. New wagers would remain prohibited under that arrangement.
The judge went further. She suspended the licence cancellation under Article 4 for CDA alone, along with relevant restrictions under Article 7 and Ministry of Justice Letter No. 1256/2026. The order also covers the financial and payment services needed to operate.
CDA Gaming Ruling Follows Stake’s Reversed Injunction
Stake Brazil had obtained an injunction on October 8. It allowed the operator to continue taking bets under restrictions until October 25. The judge declined to extend the order to the payment companies named in Stake’s application, as 15M reported.
The government challenged the decision. On October 9, the TRF-3 president suspended Stake’s injunction.
CDA’s November order specifically addresses payment infrastructure. Judge Pileggi also instructed the lower court to be notified urgently and asked the opposing parties to respond. The case remains pending.
On November 5, TMC confirmed that Casa de Apostas was operating again. Brazil’s Attorney General’s Office (AGU) told Folha de S.Paulo it would appeal the ruling.
Currency conversions are based on the Banco Central do Brasil’s PTAX exchange rate for November 3, 2026 (R$5.4935 per US dollar).
