Brazil Court Lets Stake Operate Until October 25, but Bars New Bonuses

The decision came from Judge Cristiane Farias Rodrigues dos Santos of São Paulo’s 9th Federal Civil Court. Stake Brazil had sought permission to operate through December 2029, the licence’s expiry date. The judge refused to go that far.
Two Deadlines in the Same Ban
The October 8 court decision turns on a difference between two dates in Provisional Measure 1,394/2026. Betting sites were required to shut down after ten days, with blocking scheduled for October 6. Existing authorisations, however, were set to expire after 30 days, on October 25.
The judge found that authorities could not treat Stake’s licence as already terminated before its stated expiry. The injunction preserves licence SPA/MF 263/2025 for now. It also prevents officials from blocking or redirecting stake.bet.br solely on the basis of that early termination.
Stake Can Operate, but Cannot Launch New Bonus Campaigns
The court prohibited new promotional campaigns, acquisition bonuses and initiatives intended to artificially expand the customer base. The remaining conditions cover three practical areas:
- Player restrictions. Social welfare payments cannot be used to place bets, and excluded customers must remain locked out. Existing ID and age checks, self-exclusion tools and betting limits must stay in place;
- Withdrawals and balances. Players must be able to withdraw their money. Stake also needs to keep enough funds available to cover their account balances;
- Regulatory reporting. The operator must continue submitting reports through Sigap, Brazil’s betting management system.
Nothing in the ruling explicitly forbids someone from opening a new account. What it does forbid is using fresh bonuses to attract players or running a new promotional campaign. That makes this an unusual return: Stake has a website it can operate, but cannot promote its comeback in the usual way.
Payment Firms Were Left Outside the Order
Stake had also listed OneKey Payments and Pay4Fun in its application. Both were among the institutions it wanted covered by the court order, according to BNLData. The court declined that request. Neither payment company was a defendant, so the order does not bind either firm directly.
The companies can be sent a copy of the ruling. That is different from being ordered to keep processing Stake transactions. The decision leaves it unclear which payment methods will remain available on stake.bet.br during the reprieve.
Stake Still Faces the October 25 Deadline
Brazil’s licensed betting sites went dark on October 6, as 15M reported. Stake’s relief follows from the later date for licence expiry written into the same provisional measure, not from a court finding that the wider ban is invalid.
The authorities were given ten days to respond. Regulators also retain the power to investigate individual breaches, and the injunction can be changed before October 25. The request to keep the licence valid through 2029 could be reconsidered after the authorities respond.
