Brazil’s Supreme Court Convenes Public Hearing on Fixed-Odds Betting Ban

Ten of the 19 Named Participants Sit on One Side
The hearing was convened by the Supreme Court under Justice Luiz Fux, who is serving as rapporteur on ADI 8027. That is a legal challenge launched by the Associação Nacional de Jogos e Loterias (ANJL). It asks the court to nullify the provisional measure and to protect the 2023 Bets Law.
Nineteen of the participants are already known. Among others, they are the CBF, the Brazilian Olympic Committee, the ANJL itself, and the Instituto Brasileiro de Jogo Responsável. Six are football clubs: Cruzeiro, Corinthians, Flamengo, Fluminense, Botafogo and São Paulo. That makes ten of the 19 from the sport and betting side. That is a 15M count on the court’s own list.
The rest are representatives of industry and commerce federations, the ministries of sport and finance, the solicitor-general’s office and the prosecutor-general’s office. Three more are the University Law Reform Laboratory, the broadcasting association and an economic liberal group.
Each organization may nominate up to two speakers. The hearing will commence at 10:00 in the Second Panel room, live on Rádio and TV Justiça and the court’s YouTube channel.
The solicitor-general’s office requested that Fux hold this hearing after the measure was issued.
The Market Was Already Switched Off
Fixed-odds betting was outlawed in Brazil on 25 September by MP 1.394/2026. The legislation prohibits the advertising, intermediating, offering and operating of fixed-odds betting. It also provides for ending the authorisations already granted.
On 6 October, all licensed platforms ceased operations, and their permits officially expired on 25 October, as 15M set out at the time. Article 16 reaches any content that "offers, promotes, distributes or facilitates access" to betting for a Brazilian audience, whatever the format.
Flutter projects a 2026 revenue decline of approximately $70m, while Entain saw its third-quarter Brazilian NGR plummet by 36%. Meanwhile, Betsson has completely halted all marketing, deposits, and user sign-ups.
15M counted the affiliate side after the shutdown. Coverage of the 20 most promoted brands fell from 715 sites to 418 in one week.
The Hearing Sits in a Six-Day Window
The dates are a 15M count on the measure’s own clock. The hearing falls nine days after the licences expired. It falls six days before the measure enters the urgency regime on 9 November. The first 60-day term ends on 23 November, with a possible extension of another 60 days.
Congress has barely started. The committee was named on 30 September but had not been installed as of 20 October. Of the 99 amendments filed, some would bring sports betting back.
The same measure is challenged in ADIs 8024, 8028 and 8035. The 2023 Bets Law is separately under attack in ADIs 7721, 7723 and 7749, all with Fux as rapporteur.
What This Means
- Operators: nothing reopens on 3 November. The hearing is evidence-gathering, and the decision points are the congressional clock in November and a merits ruling with no date.
- Affiliates: Brazilian traffic has no compliant destination while the measure stands, and Article 16 covers promotion regardless of how you are paid. Treat the 9 and 23 November dates as the decision points for whether to rebuild Brazilian pages or retire them.
- Providers: authorisations are being ended, not suspended, so contracts tied to Brazilian licences need a termination read, not a pause read.
What’s Next
9 November: the measure enters the urgency regime in Congress. 23 November: the first 60-day term ends. Fux has set no date for judging the merits.
