Brazil’s Betting Authorisations Lapse 30 Days After Ban Imposed

Brazil’s Betting Authorisations Lapse 30 Days After Ban Imposed
All federal and state authorisations for fixed-odds betting in Brazil expire 30 days after the publication of Provisional Measure 1.394. No refunds are available. The measure came into effect on the day it was published, and the 30 days constitute the only transitional period it offers.

Article 4 ends all concessions, permissions, and authorisations provided by Law 14.790 of 2023. Article 2 prescribes the same deadline for state and Federal District authorisations.

Thirty Days From Publication Equals 25 October

There is no end date in the text. Publication: Official Gazette, 25 September 2026, special edition. Entry into force: the same day, under Article 30. Thirty days from publication therefore ends on 25 October 2026. That date was calculated by 15M from the text, not quoted from it.

New bets ceased on day one. The month covers the wind-down duties in Chapter III and nothing else.

The Grant Payment Remains With the Treasury

Article 4 associates the extinction with the public interest and denies repayment. The one and only paragraph is precise. The extinction, it elaborates, "não confere ao agente operador de apostas direito à devolução, total ou parcial, da contraprestação de outorga recolhida". This translates to: no right, full or partial, to the return of the collected grant consideration.

Wind-Down Obligations Run on a Two-Day Clock

The procedure is as follows, as per Articles 7 and 8, as soon as access is cut off. Unsettled bets are void, with stakes refunded in full and no deductions allowed. Bets settled within the window keep their prizes payable. Two days is the deadline to fund refunds and send the banks a list of bettors based on CPF numbers. Unreturnable balances are transferred to a special Caixa Econômica Federal account overseen by the Ministry of Finance, individually recorded for every bettor.

Payment Rules Were Issued One Week After the Prohibition

Article 14 prohibits banks, payment institutions, and participants in payment arrangements, including instant payment, from processing, settling, or facilitating transactions related to fixed-odds betting. How that applies in practice, however, is set by central bank regulation.

Resolution BCB 597 is dated 30 September and bears a publication date of 2 October. This means it is five days and seven days (since 25 September), respectively, after the ban came into force, based on a 15M calculation of the two dates. In that week, the Pix rulebook remained unchanged, whereas the prohibition was in effect.
