Brazil Prosecutors Put Betting Oversight Under Review
Brazil’s Federal Public Prosecutor’s Office has opened a year-long inquiry into the Lula government’s supervision of online betting. The review covers both operator compliance and public health safeguards.

The Brazilian regulated betting sector is currently seeing a new level of scrutiny from institutions. Specifically, the Federal Public Prosecutor’s Office, known in Brazil as the MPF, has opened an investigation into how the Ministry of Finance supervises online betting operators.

The inquiry began with an administrative procedure reviewing how the Ministry of Finance monitors compliance with Law No. 14,790/2023 and Law No. 13,756/2018.

Federal Oversight Faces a Formal Test

The task of the MPF is to scrutinize the procedures followed by the Ministry of Finance and the SPA, or Secretariat of Prizes and Bets. The central question is whether the federal government has enough regulatory capacity over a market that moved from a long regulatory gap to a federal licensing model.

Currently, Brazil has 190 licensed betting platforms under SPA oversight. This figure demonstrates the potential significance of the investigation for the market. The probe is not limited to one platform or one incident.

Health Policy Enters the Same File

The review goes beyond the issue of licenses. The inquiry will also examine how Brazil’s public health system responds to pathological gambling.

This element of the review can become rather political. Gambling issues have already turned into a recurring topic in the nation’s politics. President Luiz Inácio Lula da Silva has made comments on the spread of gambling and related risks to households and society.

The MPF will assess whether prevention and treatment policies are working in practice. Public policies on prevention, harm reduction, and treatment for people affected by problem gambling will also be part of the assessment.

In Brazil, there have been established regulations relating to responsible gambling, advertising, and player protection by the SPA ordinance. Among these are Ordinance SPA/MF No. 1,231 on responsible gaming and marketing practices, and Ordinance SPA/MF No. 1,225 on supervision.

Why Operators Should Watch the Review

For licensed betting operators, the investigation increases pressure, especially when Brazil is still forming its enforcement culture. Operators already face rules on marketing, responsible gambling, payments, licensing, certification, and sanctions.

The bigger issue is how prosecutors judge the current oversight model. Should the MPF discover weak supervision, slow enforcement, or poor coordination on health measures, there could be a push on the Ministry of Finance and SPA.

The inquiry may also impact future legislative processes. There are ongoing discussions about stricter control over illegal bets, payment flows, and advertising within the industry. Such a prosecutor-initiated assessment of federal supervision might serve as a basis for lawmakers when drafting further regulations.

Brazil’s betting industry is now going through a tough phase. Licensing has allowed the emergence of the legal market. The upcoming challenge consists of proving the ability to combine supervision, sanctions, and health protection. The safest way forward for operators will be clear documentation, compliant advertising, and visible measures on responsible gambling.
