Poland Scrutinizes Sportsbook Apps and Customer Terms

The Office of Competition and Consumer Protection, UOKiK, is looking at practices used by seven betting operators: LV Bet, Fortuna, Totalbet, STS, E-toto, Superbet and Bukmacherska, the company behind fuksiarz.pl.
The regulator has not said that all of the companies broke the law. At this stage, it is checking whether parts of their services may put consumers at a disadvantage.
Closing an Account Should Not Be the Hard Part
One issue already highlighted by UOKiK is the difference between stopping and returning to gambling. A customer may have to go through several steps to suspend or close an account. Reactivating it, in some cases, can be much easier. The authority wants to know whether such differences are neutral or whether they make continued betting more likely.
Website layouts, mobile apps and messages sent to users are also being reviewed. UOKiK is using an AI-based tool during this work to help identify possible dark patterns. These can include design choices that steer a customer toward one action, hide another option or create unnecessary friction around decisions that are less profitable for the operator.
For betting companies, this pushes consumer law into an area usually handled by product and UX teams.
Five Operators Face a Separate Contract Case
UOKiK is also running proceedings against several bookmakers over their terms and conditions. This part of the case concerns Fortuna, STS, Bukmacherska, E-toto and Superbet.
The regulator is questioning clauses that may leave too much room for an operator to cancel a wager, restrict an account or decide whether a payout should be made. It says players should know the rules before a dispute arises. If contract terms are found to be unlawful, the companies involved can be fined up to 10% of annual turnover.
The contract case is narrower than the wider market review. Still, the two investigations point in the same direction. Holding a Polish betting licence does not settle every compliance question.
UX Is Becoming a Regulatory Issue
For Poland’s betting market, UOKiK’s focus on the customer journey could have wider implications for sportsbook design and compliance. That may force operators to review fairly small product choices: how many clicks it takes to close an account, how warnings appear, what a button says, or how clearly a contract explains account restrictions.
None of these points sounds dramatic on its own. Together, however, they can decide how much control a player really has over the service. That is likely to be the part of this case other Polish bookmakers will watch most closely.
